The Attorney-General has filed an application at the High Court seeking to set aside an earlier order that permitted former Chief Executive Officer of the National Food Buffer Stock Company, Hanan Abdul-Wahab Aludiba, to travel to the United Kingdom for medical treatment.
The application follows what the Attorney-General describes as new developments involving an alleged attempt by Mr. Aludiba to access funds in bank accounts that had been frozen by the Economic and Organised Crime Office (EOCO).
According to an update from Operation Recover All Loot (ORAL), the Attorney-General is arguing that the new information could have a bearing on the basis upon which the court granted approval for the medical trip on June 29.
The supporting affidavit reportedly indicates that Mr. Aludiba attempted to rely on an order from another High Court in a separate matter to access funds that were subject to valid freezing orders.
The prosecution contends that such an action would contravene provisions of the Economic and Organised Crime Office Act, 2010 (Act 804), which restrict transactions involving frozen assets.
The Attorney-General’s Office said the financial institution involved refused the withdrawal request and subsequently notified the appropriate authorities.
The development, according to the prosecution, occurred shortly before Mr. Aludiba was scheduled to travel, raising concerns over compliance with existing court directives and the ongoing criminal proceedings.
Meanwhile, Mr. Aludiba has been granted bail by EOCO following his recent arrest.
The Attorney-General’s Office has clarified that the application is part of standard legal procedures when new facts emerge after a court ruling and does not represent a decision on the merits of the case.
Mr. Aludiba remains presumed innocent until proven guilty by a court of competent jurisdiction.
He is currently standing trial alongside another accused person in connection with alleged financial offences involving the National Food Buffer Stock Company.
