Supreme Court quashes Tamale High Court ruling, NPP’s Nyindam remains Kpandai MP

The Supreme Court has overturned the Tamale High Court’s decision that annulled the December 7, 2024 parliamentary election results in the Kpandai Constituency, allowing New Patriotic Party (NPP) lawmaker Mathew Nyindam to retain his seat.

In a 4-1 ruling, a five-judge panel led by Justice Gabriel Pwamang quashed all orders stemming from the High Court judgment, including the Electoral Commission’s directive to conduct a rerun election.

Justices Amadu Tanko, Emmanuel Yonni Kulwndi, Samuel Asiedu, and Henry Anthony Kwofie formed the majority, while Justice Pwamang dissented.

Nyindam had challenged the Tamale High Court’s ruling in favor of NDC candidate Daniel Nsala Wakpal, arguing that the court lacked jurisdiction over the petition. Following the High Court’s annulment, the NPP had secured a stay of execution to halt the rerun pending the Supreme Court’s decision.

The ruling effectively cancels the Electoral Commission’s plan to conduct a rerun, allowing Nyindam to continue representing the Kpandai Constituency.

Meanwhile, a poll by Global InfoAnalytics had shown Nyindam with a narrow lead of 50% against Wakpal’s 46%, within the margin of error.
