A legal tussle has emerged over the burial and funeral arrangements of highlife legend Charles Kwadwo Fosu, popularly known as Daddy Lumba, after five individuals claiming to be his immediate maternal family filed a suit at the High Court in Accra.

The plaintiffs, all based in Kumasi, are seeking to stop Transitions Funeral Home from releasing the musician’s body to any person or group without their consent.

They argue that as principal maternal family members, they must approve any decision concerning the release of the body and the conduct of funeral rites.

The suit, filed on December 3, also names Kofi Owusu Abuakwa and CAL Bank Ghana as defendants. Beyond the custody of the body, the family is challenging the handling of funds linked to the Daddy Lumba Memorial Foundation, which is being used for funeral arrangements.

They are asking the court to freeze the foundation’s account at CAL Bank, restrain a dissolved committee from accessing the funds, and compel the refund and accounting of any withdrawals made without their approval.

In addition, the family wants existing signatories removed and replaced with a new committee appointed by the head of Daddy Lumba’s immediate family, and is seeking an injunction to block any funeral-related actions without their involvement.

The court action introduces fresh uncertainty into preparations for the final rites of one of Ghana’s most iconic musicians.
