GRA: Digital VAT system will not impose additional 20% tax on subscriptions

The Ghana Revenue Authority (GRA) has clarified that its new digital Value Added Tax (VAT) collection system will not introduce an additional 20% tax on subscriptions and payments for digital services such as Netflix, Google and Amazon.

The Authority said the system was designed to improve the collection and accounting of existing taxes applicable to digital services supplied by non-resident companies to consumers in Ghana.

In a statement issued by its Communication and Public Affairs Department, the GRA stressed that the initiative would neither introduce a new tax nor increase the existing effective tax rate of 20%.

The rate comprises 15% VAT, a 2.5% National Health Insurance Levy (NHIL) and a 2.5% Ghana Education Trust Fund (GETFund) Levy.

The clarification follows media reports and public discussions suggesting that the introduction of the new collection mechanism would result in an additional 20% charge on digital subscriptions and other online services.

According to the GRA, VAT on electronically supplied services by non-resident providers is an existing statutory obligation under Ghana’s tax laws, and the new system is intended to ensure that the taxes due are properly collected.

The Authority said approximately 92 non-resident digital service providers were already registered and remitting VAT, while about 100 additional providers had been identified for progressive inclusion in the tax net.

It explained that consumers who already pay the applicable taxes through subscription prices should not be charged again for the same transaction following the introduction of the new system.

However, users of digital services whose providers have not been charging and remitting the applicable taxes could see the statutory charges reflected in their payments once those providers are brought into compliance.

The GRA said the new mechanism would allow the tax component of qualifying transactions to be identified and collected at the point of payment through participating financial institutions and payment service providers.

Under the existing arrangement, the Authority largely relies on foreign digital service providers to declare their transactions and remit the taxes due.

The new system is expected to strengthen compliance, improve transparency and ensure that revenue owed to the State is properly accounted for.

The Authority also clarified that the system applies to qualifying electronically supplied services, including streaming subscriptions, cloud computing, online gaming and digital advertising, paid for using Ghana-issued payment instruments such as bank cards, mobile money and other digital payment platforms.

Physical goods purchased from international e-commerce platforms will continue to be subject to the applicable Customs procedures.

The GRA said it recognised the need to protect consumers from duplicate taxation and ensure that the applicable charges were clearly communicated.

It added that it would continue engaging banks, payment service providers and digital service providers to establish appropriate safeguards against duplicate collection.

Consumers who encounter charges they believe are inconsistent with the clarification have been encouraged to contact the Authority through its official channels for clarification and redress.

The GRA said the initiative was intended to promote fairness between resident and non-resident service providers, strengthen compliance with existing tax laws and improve domestic revenue mobilisation through technology.
