Northern Ashanti Mines Limited has filed an application for an interlocutory injunction at the High Court in Accra, seeking to prevent the state from taking over its US$110 million mining investment at Konongo in the Ashanti Region.
The company wants the court to restrain security agencies from entering its mining site, seizing its property or interfering with its operations while it challenges the termination of its mining lease.
The application was filed on October 22, 2026, at the registry of the Commercial Division of the High Court. The Minerals Commission, the Minister of Lands and Natural Resources, and the Attorney-General have been named as defendants.
The motion is expected to be moved on Thursday, October 29, 2026.
In its application, Northern Ashanti Mines is asking the court to prevent personnel of the Ghana Armed Forces, the National Anti-Illegal Mining Operations Secretariat (NAIMOS), the Ghana Police Service and other security agencies from taking control of its mining site.
The company wants the court to restrain them from “entering upon, seizing, taking over, occupying, or in any manner interfering with” its possession of the mine.
The requested order would also protect the company’s staff, equipment, facilities, records and other property within the Konongo Mining Lease area in the Asante Akim District of the Ashanti Region.
Northern Ashanti Mines is further seeking an order to prevent the defendants from deploying or authorising military and other security personnel to take over the mine or enforce the purported termination of its lease.
The company is challenging a Minerals Commission letter dated April 30, 2026, concerning the termination of the mining lease.
It also wants the court to stop the defendants from granting, transferring or reallocating mineral rights over the disputed area to any third party, whether Ghanaian or foreign.
The request includes preventing the processing or approval of applications for mineral rights over the area, as referenced in a letter from the Asante Akim North Municipal Assembly dated August 18, 2026.
The company is asking the court to maintain these restrictions until the final determination of its separate application for judicial review, which challenges the decision to terminate its mining lease.
Northern Ashanti Mines filed the judicial review application at the High Court in Accra on October 21, 2026. It is seeking to have the termination declared unlawful and quashed.
The dispute centres on the Minerals Commission’s April 30 letter concerning the company’s mining lease at Konongo. Through the two applications, Northern Ashanti Mines is seeking to challenge the termination and prevent any takeover or reallocation of the disputed mining area while the court considers the matter.
The injunction application is intended to protect the company’s possession of the site and its mining operations during the legal proceedings.
The court is yet to determine the applications.
