Mahama: Judicial independence a constitutional guarantee, not an Executive favour

President John Dramani Mahama has said the independence of the Judiciary is a constitutional guarantee and not a favour granted by the Executive.

Speaking on behalf of the President, Chief of Staff, Dr. Julius Debrah, said the government recognises the distinct responsibilities of the Executive, Legislature and Judiciary and will continue to respect the autonomy of the courts.

He made the remarks at the opening of the second Quadrennial Delegates’ Conference of the Judicial Service Staff Association of Ghana (JUSAG) at the University for Development Studies in Tamale.

“President Mahama remains steadfast in his respect for the independence of the Judiciary. Our Constitution gives the Executive, Legislature and Judiciary distinct responsibilities, but binds all three to one national purpose: upholding the rule of law and serving the people,” Dr. Debrah said.

“That independence is not a favour granted by the Executive; it is a constitutional guarantee and an indispensable safeguard of our democracy,” he added.

Dr. Debrah said government would continue to support the Judiciary to improve the administration of justice and expand access to the courts while respecting its independence.

He also commended Judicial Service staff for their role in justice delivery and described the Judicial Service (Terms and Conditions of Service) Regulations, 2025, C.I. 141, as a major step towards improving staff welfare and ensuring greater certainty in their conditions of service.

He added that government would continue supporting the Judiciary’s digital transformation to reduce delays, improve transparency and make justice more accessible to citizens across the country.
