Lawyers representing the former Chief Executive Officer of the National Buffer Stock Company, Hanan Abdul-Wahab, have filed an application at the Criminal Division of the Accra High Court seeking to strike out a new charge sheet brought against their client by the prosecution.
The application follows the withdrawal of earlier charges against Mr. Abdul-Wahab, after which the prosecution filed fresh charges, citing the discovery of new evidence in the case.
However, during proceedings, lead counsel for the accused, Godfred Yeboah Dame, informed the court that the defense had challenged the validity of the new charges.
According to Mr. Dame, the defense believes the charges are “fatally defective” and violate the constitutional rights of the accused person.
The lawyers are therefore asking the court to set aside the fresh charges and prevent the prosecution from proceeding with the case in its current form.
The court is expected to hear arguments from both sides before determining the next steps in the matter.
