EOCO probes Asante Berko bribery case after US conviction, begins asset tracing

The Economic and Organised Crime Office (EOCO) has intensified its investigations into the Ghanaian dimension of the bribery case involving former Tema Oil Refinery (TOR) Managing Director, Asante Kwaku Berko.

This follows allegations that Mr. Berko was involved in a bribery scheme linked to a power project in Ghana, which has since led to proceedings and his conviction in the United States.

In a statement dated August 10, 2026, EOCO said it had been working with the Attorney-General and the US authorities to obtain information relevant to the Ghanaian aspect of the case.

The Office said it initially received a request from its US counterparts last year for information on specific individuals in Ghana considered relevant to the investigation, including a former Minister of State and public servants.

“Following receipt of the request, EOCO, in collaboration with the Attorney-General and Ministry of Justice, commenced preliminary work in relation to the Ghanaian aspects of the matter,” the statement said.

EOCO said it closely monitored the US proceedings, as evidence from the case could help determine the scope and direction of its investigation in Ghana.

Following Mr. Berko’s conviction, the Attorney-General and Minister for Justice engaged the US authorities to obtain relevant evidence, records and information.

“The Attorney-General has subsequently directed EOCO to escalate its investigations as the relevant information and official records are obtained from the competent authorities in the United States,” EOCO stated.

The Office said it has therefore commenced the process of intensifying its investigation into the Ghanaian dimension of the case.

EOCO said asset tracing and recovery will form part of its investigation, particularly where evidence points to the unlawful acquisition or use of public resources.

“Importantly, and consistent with its statutory mandate, asset tracing and recovery form an integral part of EOCO’s investigative plan in this matter,” it said.

The Office said it will examine relevant transactions, beneficiaries, assets and proceeds that may be connected to suspected criminal conduct.

EOCO, however, stressed that the conviction of Mr. Berko in the United States does not automatically establish criminal liability against anyone in Ghana.

“EOCO wishes to emphasize, however, that the conclusion of proceedings against Mr. Berko in the United States does not, by itself, establish criminal liability on the part of any person in Ghana,” the statement said.

It added that anyone whose name emerges from the evidence will be assessed independently in accordance with Ghanaian law.

EOCO said it would continue its collaboration with US law-enforcement authorities and the Attorney-General’s Office while withholding sensitive operational information that could affect the ongoing investigation or any future prosecution.
