The Commercial Division of the High Court in Accra has granted a warrant of police assistance to UK-based Cola Holdings Limited and its appointed receiver, Nii Amanor Dodoo, to take possession of the No. 1 Oxford Street Hotel at Osu in the Greater Accra Region as part of efforts to enforce a security interest over the property.

The order was issued by Justice Samuel Faraday Johnson on July 21 following an application by Cola Holdings and the receiver, who informed the court that they had been unable to obtain possession of the hotel peacefully.

The application was opposed by Kensington Residential Partners 1 Limited through one of its directors, Nana Kwame Bediako, popularly known as Cheddar.

However, the court dismissed the objections raised by the company.

In its ruling, the court held that Cola Holdings had properly registered its security interest over the property at the Collateral Registry and had also secured a Memorandum of No Objection authorising it to realise the security.

Justice Faraday Johnson further ruled that under the Borrowers and Lenders Act, 2020 (Act 1052), the company was entitled to seek police assistance after encountering resistance in taking possession of the property.

The court also found that Kensington Residential Partners 1 Limited had failed to provide sufficient evidence to justify refusing the application.

Consequently, the court granted leave for a warrant of police assistance to enable Cola Holdings and the receiver to take possession of the hotel and proceed with the realisation of the security in accordance with the law.

Court records indicate that legal representation for Cola Holdings and the receiver was led by Tsatsu Tsikata and Tata Kosi Foliba, while Kensington Residential Partners 1 Limited was represented by Bobby Banson and Isaac Akerefie-Mensah.

The court clarified that the ruling relates solely to the application for police assistance and does not determine any other legal issues or claims that may arise between the parties.

The latest decision forms part of an ongoing legal dispute over the enforcement of a security interest in the No. 1 Oxford Street Hotel.

Court records show that Nii Amanor Dodoo was appointed receiver by Cola Holdings under the Borrowers and Lenders Act after the company initiated steps to realise its security over the property.

The matter is also linked to proceedings concerning the enforcement in Ghana of a judgment of the High Court of England and Wales involving Cola Holdings Limited.

In January 2026, Nana Kwame Bediako publicly maintained that he disputes liability under the foreign judgment and has instructed his lawyers to challenge its enforcement in the Ghanaian courts.

He stated that the transaction arose from a financing facility obtained by Kensington Residential Partners 1 Limited from the International Finance Corporation and said he intends to pursue all available legal remedies, including an appeal against the registration of the foreign judgment in Ghana.
