Okaikwei Central MP Patrick Boamah says credit must be given to all those whose efforts contributed to Ghana’s successful defence in the nearly US$400 million tax arbitration brought by Tullow Ghana Limited.

Reacting to the International Chamber of Commerce (ICC) tribunal’s ruling in favour of Ghana, Mr Boamah said the outcome followed several years of legal and procedural work involving successive administrations and legal teams.

He noted that Tullow initiated the arbitration in February 2023, after which Ghana responded to the claim, filed a counterclaim, nominated its arbitrator and challenged Tullow’s initial nominee. He also pointed to the appointment of Washington-based law firm Foley Hoag LLP to represent Ghana in the proceedings.

Mr Boamah said Ghana’s Statement of Defence was subsequently filed in September 2024, supported by statements from four factual and legal witnesses. He said these were among the many procedural steps taken between 2023 and 2025 as Ghana contested Tullow’s claims.

“The above constitutes only a little bit of the many procedural steps taken between 2023 and 2025 to contest the arbitration claim,” Mr Boamah wrote on Facebook on Wednesday, September 30.

While acknowledging the role played by former Attorney-General Godfred Yeboah Dame during part of the proceedings, Mr Boamah said the focus should be on recognising the collective efforts that went into Ghana’s successful defence rather than attributing the outcome to one individual.

The ICC ruling follows the dispute over tax assessments involving Tullow Ghana Limited and represents the conclusion of the arbitration proceedings brought against the Republic of Ghana.
