The Kumasi High Court has ruled that Akosua Serwaa Fosuh cannot be declared the sole surviving spouse of the late highlife musician Daddy Lumba, upholding the rights of Priscilla Ofori, popularly known as Odo Broni, as a legal wife.

Presided over by Justice Dorinda Smith‑Arthur, the court found that Serwaa failed to provide an original certified copy of her alleged civil marriage certificate from Germany, noting that the submitted documents were extracts rather than originals.

The ruling confirms that both women are recognized under the law and may participate in widowhood rites and funeral arrangements, while also having rights over the late musician’s estate.

The dispute arose after Daddy Lumba’s death on July 26, 2025, when both women claimed to be his lawful widow.

Serwaa had sought a declaration naming her the sole legal spouse and tried to block funeral proceedings, but the defence highlighted her customary marriage may have been dissolved and emphasized Odo Broni’s long-term cohabitation and family with the late musician.

Justice Smith‑Arthur underscored that Ghanaian law treats civil and customary marriages independently, allowing for multiple valid marital claims.

The decision ends months of legal battles and controversy, providing clarity for the late musician’s funeral and estate matters, with certified copies of the judgment expected on December 1, 2025.
