A United States Immigration Court has granted the I-485 adjustment of status petition filed by former Finance Minister Ken Ofori-Atta, according to a statement issued by his solicitor.
The statement said the court considered evidence relating to actions taken by the Office of the Special Prosecutor (OSP), including its earlier decision to declare Mr. Ofori-Atta a fugitive from justice.
According to the solicitor, the court heard that the declaration was made while the former minister was reportedly undergoing medical treatment in the United States and at a time when his lawyers were in communication with investigators in Ghana.
The statement further claimed that the court found the criminal charges against Mr. Ofori-Atta in Ghana “not credible.”
However, the solicitor clarified that the ruling was delivered within the context of immigration proceedings in the United States and was focused on determining whether Mr. Ofori-Atta met the legal requirements for adjustment of status under US immigration law.
The decision, according to the statement, relates specifically to his immigration application and not to any criminal proceedings currently associated with him in Ghana.
