A senior official of the Ghana Maritime Authority (GMA), Mubarick Masawudu, has been named in allegations of interference in a land dispute currently before the High Court in Accra.
The allegations relate to a parcel of land at Spintex, Accra, which is the subject of an injunction application in Suit No. LD/0516/2026 involving Artin Kassardjian and Haykouhi Kassardjian as applicants and Abdul Razak, Amos Sowah Pablo Annan and another party as respondents.
According to information available to this portal, Mr Masawudu is alleged to have appeared at the disputed property and to have backed one of the factions involved in the dispute.
It is further alleged that persons described as land guards were used in connection with efforts to take control of, or maintain occupation of, the property.
A certified order issued by the High Court, Land Division Eleven, Accra, on August 27, 2026, authorised substituted service of the injunction application and originating motion on the respondents.
The order directed that copies of the court processes be posted at the Land Division of the Law Court Complex and on the disputed land at Spintex.
It further directed that the notice remain posted for 21 days.
An Official Certificate of Result of Search issued by the Lands Commission on July 22, 2026, provides a documentary record of dealings involving the property.
The search, conducted for BAFLA Limited, records a lease dated December 7, 2017, from Nuumo Adjei Kwanko II to Samuel Kofi Diame.
It also records a July 9, 2018 judgment in favour of Samuel Kofi Diame under Suit No. LD/0424/2017.
Further entries in the search indicate that the land was affected by a plotted activity for Joemat Real Estate Development Limited, with Samuel Kofi Diame identified as grantor.
The records also reference Land Certificate No. GA56155, issued to Joemat Real Estate Development Limited, with Mr Diame identified as grantor.
Documents relating to the property include a Land Certificate issued under the authority of the Land Title Registry in Accra.
The certificate identifies Joemat Real Estate Development Limited as the registered tenant or lessee for the unexpired residue of a 99-year lease commencing December 7, 2007.
The property is stated to cover approximately 24.42 hectares, equivalent to 60.33 acres, at Spintex in the Greater Accra Region.
It is identified as Parcel No. 7359, Block 2, Section 097, and is delineated on Registry Map No. 002/097/1992.
The competing documentary claims are expected to be relevant to the court’s determination of the respective interests of the parties in the property.
The dispute has also generated allegations concerning activities at the site.
Information supplied to this portal alleges that Mr Masawudu, described in the material as a Deputy Maritime Authority Director, visited the disputed property in circumstances involving persons described as land guards.
It is further alleged that police officers were present at the site but that activities on the property continued after the officers left.
These claims remain unproven and have not been established by the court.
Photographs of the property supplied in connection with the dispute show construction activity, including block work, reinforced concrete columns and structures at various stages of development.
The ongoing construction has raised questions about who currently exercises physical control over the property and the legal basis for the development while the ownership dispute remains before the court.
The allegations involving Mr Masawudu have also raised questions about the involvement of public officials in private property disputes.
Holding public office does not, in itself, establish a proprietary interest in disputed private property. Any allegation that official influence was used to secure possession or control of land would, however, require appropriate investigation and evidence.
The central legal question remains for the High Court to determine: which party has the superior legal interest in the property and whether any conduct complained of constitutes unlawful interference with that interest.
Attempts to obtain a response from Mubarick Masawudu regarding the allegations, including whether he has any proprietary or contractual interest in the property, whether he was present at the site, or whether he had any involvement in the activities there, proved unsuccessful as of press time.
