President John Dramani Mahama has formally referred 10 petitions seeking the removal of the Electoral Commission (EC) Chairperson, Jean Mensa, her two deputies, Dr. Bossman Asare and Samuel Tettey, and Special Prosecutor Kissi Agyebeng to the Chief Justice, Justice Paul Baffoe-Bonnie, for further action.
Seven petitions target the EC leadership, while three focus on the SP. The referral follows constitutional provisions under Article 70(2) of the 1992 Constitution, which require the President to submit removal petitions of heads of constitutional bodies to the Chief Justice for assessment of a prima facie case.
If a prima facie case is found, the Chief Justice will convene a committee to investigate and make recommendations to the President, who is constitutionally bound to act accordingly. For the Special Prosecutor, the process is guided by Section 15 of the Office of the Special Prosecutor Act, 2017, which includes specific timelines for investigation and committee recommendations.
This referral sets in motion the constitutional process for determining whether the heads of the EC and SP should be removed from office for alleged misbehaviour, incompetence, or incapacity.
